IMPLEMENTING GUIDELINES ON THE EXTENDED ENHANCED COMMUNITY QUARANTINE IN THE PROVINCE OF PANGASINAN
WHEREAS, the State is mandated to protect and promote the right to health of the people under Article 2, Section 15 of the 1987 Philippine Constitution, and LGUs are empowered to exercise necessary, appropriate and incidental powers for its efficient governance in promotion of general welfare, as provided by Section 16 of Republic Act No. 7160, otherwise known as Local Government Code of 1991; WHEREAS, pursuant to Proclamation No. 922 s. 2020, the Philippines was declared to be under a State of Public Health Emergency with Code Alert System raised to Code Red Sublevel Two due to the nationwide spread of the 2019 Corona Virus Disease (COVID-19) pandemic; WHEREAS, Proclamation No. 929 s. 2020 was issued declaring a State of Calamity throughout the Philippines due to Corona Virus Disease 2019 and thereafter, President Rodrigo R. Duterte placed the entire Luzon area under Enhanced Community Quarantine (ECQ), prompting local government units to comply and implement appropriate measures to arrest the spread of the disease, while at the same time ensuring the provision of basic services in their respective jurisdictions; WHEREAS, Republic Act No. 11469 or the Bayanihan to Heal as One Act was enacted to mandate LGUs to act within the letter and spirit of all rules, regulations, and directives in implementing standards of Community Quarantine and to exercise autonomy in matters undefined by the National Government, and to ensure that LGUS fully cooperate towards a unified, cohesive and orderly implementation of policies to address COVID-19; WHEREAS, pursuant to IATF Resolution No. 29, approved by President Rodrigo R. Duterte, the Enhanced Community Quarantine within the Province of Pangasinan was extended until May 15, 2020; WHEREAS, there must be a continuous effort to address and contain the spread of COVID-19 for the welfare of the residents of Pangasinan. NOW, THEREFORE, I, AMADO I. ESPINO, III, Governor of the Province of Pangasinan, Philippines, do hereby implement the following measures: SECTION 1. EXTENSION OF THE ENHANCED COMMUNITY QUARANTINE (ECQ). A. The Province of Pangasinan is hereby placed under extended Enhanced Community Quarantine for the period of May 1, 2020 to May 15, 2020, or until so declared in subsequent official issuances. B. The movement of people shall be exclusively for the purpose of accessing basic necessities and things essential to survival such as food and medicine. C. There will be a continued presence of uniformed personnel and quarantine officers for a proper enforcement of quarantine rules. D. Minors (below 18 years of age) and senior citizens (60 years old and above), those with co-morbidities or other risk factors shall stay at home. Persons who are considered to be at a high risk of being infected, including infants, and elderly, those who are immunocompromised and pregnant women are strictly prohibited from leaving their homes. SECTION 2. CURFEW. For the extended duration of the ECQ, a province-wide curfew from 8:00 PM to 5:00 AM, shall continue to be implemented, subject to the exemptions provided herein. SECTION 3. CONTINUED STRICT HOME QUARANTINE. A. Residents, permanent or otherwise, are prohibited from leaving their homes or lodging facilities, except to buy essential commodities and other things necessary for survival. In such cases, only one person per household is allowed to go outside to buy basic necessities. B. Only those with valid Home Quarantine Pass limited to one per household and with valid identification card, shall be allowed to go outside the confines of their homes to buy basic necessities. C. The scheme/schedule adopted by component LGUs in allowing their residents to secure basic necessities shall continue to be observed. However, the operation of supermarkets, public and private wet markets, grocery stores, and other retail establishments engaged in the selling of basic necessities shall be for a maximum period of 12 hours (IATF-EID Resolution No. 18 land b). D. The following are exempted from strict home quarantine: (APOR) I. BASIC SERVICES 1. Medical Services a. DOH officials and staff b. Philhealth officials and personnel c. all LGU health personnel (including RHU personnel, BHW, etc.) d. Red Cross personnel and staff e. Public and private hospital staff and personnel f. Private Care Givers 2. Security Services a. PNP, AFP, BJMP, NBI and other law enforcement agency personnel b. Private company security officers and security guards c. Deputized force multipliers (Barangay officials, Barangay Tanods, BSPO) 3. Emergency Responders a. DRRM staff and personnel and their local counterparts (MDRRMO, PDRRMO) b. BFP c. DSWD staff and personnel d. DILG Emergency e. Barangay Health Emergency Response Team f. LGU officials 4. Funeral Services a. Employees and personnel of Funeral Parlor and/or Crematorium b. Immediate Family/ Next of kin of the deceased c. Officiating priests, Imam, Pastors and/or other Religious ministers II. DAILY ESSENTIALS 1. Banks/ Money Exchange/Transfer Services and Pawnshops a. Bank Tellers/Employees b. ATM Services/ Technical Support Crew c. Armored Vehicle crew d. Money Exchange/Transfer Services e. Pawnshop employees 2. Employees of Hypermarkets/Supermarkets/Groceries/Convenience Stores and Sari sari Stores 3. Public Markets and Rolling Stores of Food 4. Pharmacies and Drugstores 5. Fastfood/ Food Chains/ Restaurants/ Carinderia engaged in Drive Thru/ Pick-up/ Delivery and/or Take out III.ESSENTIAL GOODS 1. Delivery personnel of cargoes (en route to or from delivery point) 2. Logistics/ Warehouse Establishment employees 3. Delivery personnel of food, water, medicine and other basic necessities 4. Employees of suppliers/manufacturers engaged in the production, manufacturing and distribution of a. Food b. Hygiene Products c. Medicines and Vitamins d. Medical supplies such as PPEs, masks, gloves and the likes e. Veterinary supplies, Animal/Livestock/Pet food IV. PUBLIC UTILITIES 1. Telecommunications a. Key officials and employees b. Repair/Work crew of Water Companies b. Water Delivery and Refilling Stations 3. Sanitation Services a. Industrial waste collectors b. Residential/ Market waste collectors and transporters c. Hospital/Toxic waste collectors, treaters and transporters 4. Energy Companies a. Electric Power Generation, Transmission and Distribution employees b. Petroleum Tanker drivers and crew c. Gasoline attendants V.OTHER AUTHORIZED PERSONS 1. Private Individuals (1 per household procuring food and medicines) 2. Skeletal Force of Government offices in the Executive Branch 3. Judiciary and Prosecution Services a. Judges and staff of RTC, CTC, MTC, MCTC b. Government Prosecutors and key personnel c. Public Attorney's Office d. Legal counsel of accused or those availing of emergency/ extra-ordinary legal remedies/ Writs 7. Authorized Media Personnel with ID or accreditation from the PCOO and/or Provincial Information Office (PIO) 8. Agribusiness and Agricultural Workers a. Farm owners, farm workers, fishermen b. Employees of Agricultural supply stores/outlets c. Veterinarians and employees of veterinary clinics 9. Business Processing Outsourcing (BPO) personnel 10. Critical Transportation Facilities employees a. airport/ port employees b. toll operators and key personnel of toll companies 11. Outbound/Inbound International Passengers, including departing OFWs 12. Employees of the Philippine Postal Corporation 13. PAGASA Field Station Personnel E. Transit to and from work shall only be allowed for the above enumerated workforce, provided that there is proof of employment and shift schedule from their respective employers/ offices. F. The above exempted persons shall be required to show proper documentation (e.g. valid government issued ID, passport, travel itinerary, etc) and nonetheless be subjected to monitoring and thermal scanning by quarantine officers and are directed to observe strict social distancing. SECTION 4. QUARANTINE CHECKPOINTS. The Pangasinan Provincial Police Office (PPPO), Armed Forces of the Philippines (AFP), Bureau of Fire Protection (BFP), Provincial Health Office (PHO), and Provincial Disaster Risk Reduction and Management Office (PDRRMO), their municipal, city and barangay counterparts and their authorized and deputized force multipliers shall continue to man the quarantine checkpoints at strategic border points across Pangasinan. The following guidelines for the quarantine checkpoints shall be imposed: A. Persons who travel from outside of the Province shall be denied entry in the said check points, except those specifically provided herein; B. Persons who, are allowed entry to the Province must be checked for symptoms of COVID-19 infection. Incoming travelers must undergo strict home quarantine. Persons manifesting symptoms of COVID-19 infection shall be submitted to the nearest medical or quarantine facility. C. All persons, including returning OFWs, seamen or seafarers, who gained entry to the Province are directed to report to their respective barangays/Barangay Health Emergency Response Team (BHERT) and to observe self-quarantine for fourteen (14) days, except those above enumerated herein. D. Cargo movement, especially of food, medicine and essential commodities within the Province shall be allowed unhampered access, subject to the guidelines released by the DTI regarding the accompanying crew and personnel. E. Vehicles / dump trucks used in solid waste management shall likewise be allowed to collect segregated wastes and transport them to accredited treatment facilities and disposal areas/sanitary landfills. SECTION 5. CONTINUED SUSPENSION OF MASS PUBLIC TRANSPORTATION. A. Operation of mass public transport including but not limited to public utility buses, jeepneys, tricycles, pedicabs and taxis shall continue to be suspended, except when responding to an actual emergency and/or duly tasked by authorized agencies of government. B. Private transportation/vehicles allowed to operate pursuant to this rules shall still be subjected to safety measures such as thermal scanning and inspection procedures. C. Ambulances, cargo trucks, delivery trucks, vehicle with Covid pass or travel pass and/or authorized vehicles shall be used exclusively for the purpose for which they are intended. They shall not be allowed to transport commuters, travelers or be used to avoid checkpoints or in any way circumvent quarantine policies and procedures. SECTION 6. CONTINUED SUSPENSION OF CLASSES A. Classes shall continue to be suspended from May 1, 2020 to May 15, 2020, Provided, that schools may continue to employ alternative learning methods, such as online classes to fulfill their educational requirements. Classes shall resume upon official notice from the DepEd, CHED, and other competent authorities. B. Graduations/ Recognition Rites/ Moving Up Ceremonies or those drawing large public attendance shall not be allowed. C. Sport competitions, social activities, whether school oriented or private sponsored shall continue to be prohibited. D. No child or minor shall be allowed to loiter in the streets, buildings, or any establishments outside of his/her residence at any time of the day. It shall be the responsibility of parents and guardians to ensure that their children or wards remain in their respective residences. SECTION 7. MODIFIED WORK ARRANGEMENTS. A. Government offices shall not be in full operation, but a minimum/skeletal workforce maybe present in the regular offices, so as not to unnecessarily disrupt public service. Memorandum Circular No.7, S. 2020 of the Civil Service Commission (CSC) shall be considered or complied with. However, health, peace & order, emergency and essential personnel shall continue to report in their respective field or hospital assignment. B. Alternative/modified work arrangements such as, but not limited to work from-home mechanism, skeletal workforce, shall continue to be implemented in the workplace, as far as practicable, provided that monitoring scheme on the whereabouts and output of work will be implemented by the respective heads of offices/agencies. C. Companies in the private sector, are encouraged to adopt a flexible work arrangement for its employees, provided that strict social distancing measures are required to be observed by their respective managements. D. The above work scheme shall not be applicable to the PNP, AFP, peace and order personnel, health and emergency frontline services, border control and other critical services, as they are collectively tasked to effectively and efficiently implement the emergency measures stated herein. SECTION 8. LIMITED OPERATION OF PRIVATE ESTABLISHMENTS A. All department stores, shopping malls, and establishments drawing large number of persons will continue to be closed during the extended quarantine period. B. Establishments providing basic necessities and essential commodities shall be allowed to operate in a limited capacity, provided that safety and precautionary procedures are implemented in their workplace, to include the following: 1. public markets, supermarkets, groceries, convenience stores; 2. hospitals, pharmacies, medical supplies and drug stores; 3. food production, preparation, and delivery services; 4. water-refilling stations; 5. manufacturing and processing plants of basic food products; 6. banks, money transfer services; 7. public utility companies on energy, water and telecommunications; 8. press or mass media; and 9. gasoline and fuel stations. All private establishments allowed to operate are mandated to observe strict social distancing, mandatory wearing of face masks and other safety and precautionary measures to support operations. SECTION 9. FOOD ESTABLISHMENTS. Restaurants, eateries, and fastfood chains will remain in operation insofar as food preparation, pickup, take out, drive thru and delivery is concerned. Dine in shall not be allowed. Buffet and eat all you can” arrangements shall be strictly prohibited. SECTION 10. CONTINUED CLOSURE OF RECREATIONAL ESTABLISHMENTS. Tourist destinations and all recreational facilities across the Province of Pangasinan shall be closed and be made unavailable to the public during the quarantine period. Operation of cockpits, bingo stations and gaming stations is strictly prohibited. SECTION 11. LIQUOR BAN A. Manufacture/Selling/ distribution of alcoholic beverages shall be prohibited during the extended duration of the ECQ. B. Drinking of alcoholic beverages in public places is strictly prohibited at all times to ensure the policy of social distancing. SECTION 12. CONTINUED PROHIBITION OF MASS GATHERINGS. A. Public gatherings in barangays, municipalities, and component cities which draw a large number of people, such as celebration of barangay fiestas and festivities, barangay assemblies, town/city fiestas, reunions, trade fairs, carnivals, balikbayan affairs, concerts, fund raising events, and other public events shall still be suspended, until further notice. B. Churches and religious groups are not prevented from exercising their beliefs and worship. However, all large gatherings and mass congregations are prohibited during the quarantine period. As an alternative, religious groups may consider conducting Mass celebrations and group prayers/worship through online platforms. SECTION 13. PROHIBITION ON HOARDING, PROFITEERING, INJURIOUS SPECULATIONS, MANIPULATIONS OF PRICES, PRODUCT DECEPTIONS AND OTHER PERNICIOUS PRACTICES. Hoarding and/or reselling of basic commodities with price spikes is strictly prohibited. All sellers must observe the Department of Trade and Industry (DTI) price freeze on essential medicines, basic medical supplies, hygiene and sanitation products such as face masks, rubbing alcohol, hand sanitizers, and basic food supplies, such as but not limited to canned sardines, bread, instant noodles, coffee and bottled water. The supply, distribution and movement of fuel, fertilizers, chemicals, building materials, implements, machineries and equipment, spare parts required in agriculture, industry, and other essential services and other articles of prime necessity shall be strictly monitored. SECTION 14. PROHIBITION ON SPREADING FAKE NEWS. A. Spreading unverified reports regarding COVID-19, whether with malice or not, is strictly prohibited. Intentionally providing misinformation is a violation of Section 9(b) of Republic Act No. 11332 (Mandatory Reporting of Notifiable Diseases and Health Events of Public Health Concern Act), and shall be penalized accordingly. B. Fake news on social media shall be immediately reported to the administrator and/or media platform, and may be summarily be removed when circumstances warrant it. This shall be without prejudice to whatever civil and/or criminal sanctions that may later be instituted. SECTION 15: PROHIBITION ON SOLICITING DONATIONS THROUGH MISREPRESENTATION OR FRAUDULENT MEANS. SECTION 16. STRENGTHENING OF FOOD SUPPLY LINKS FROM FARM AND OTHER FOOD SOURCES TO MARKETS. Pursuant to DILG Advisory dated April 19, 2020, component LGUs are hereby directed to: A. In addition to forging agreements with the NFA, enter into contracts or make arrangements with their local fishers and farmers for the procurement of their produce at appropriated prices, for inclusion in the distribution of food packs for households; B. Render assistance to municipal fisher folks and farmers in bringing their products to the market; C. Include the products of municipal fisher folks and farmers in bringing the market/goods closer to the people e.g. online marketing, community markets, and market on wheels. SECTION 17. PROPER WELFARE FOR PERSONS WITH DISABILITIES A. Component LGUs must include in their list of beneficiaries persons with disabilities in the distribution of food packs indicating therein the kind of food items received including medicine and vitamins. B. LGUs must ensure that persons with disabilities are able to access adequate food with the needed nutritional requirement as provided by law and should allow the use of vehicles for persons with disabilities under emergency situation. SECTION 18. TEMPORARY ECONOMIC RELIEF TO INDIVIDUALS AND BUSINESSES.
Component LGUs are advised to: A. Adopt fast-track measures to ensure unhampered delivery of government services. B. If the circumstances so warrant and without prejudice to existing laws, exercise discretion in the emergency extension of validity of LGU licenses, permits, clearances, certifications, authorization that are expiring while under community quarantine. C. Use of emails and online platforms to enable electronic submissions and approvals. D. Suspension of notarization requirement for submission of documents to be submitted, unless specifically required by law. E. Reduction of requirements and signatories subject to completion after a designated period or when the conditions normalize and use of electronic signatures or pre-signed license, clearance, permit, certification or authorization with adequate security and control mechanism. F. Whenever necessary and practicable, employ an online payment scheme or outsourced payment collection centers for transactions. G. Imposition of fines may be relaxed and extension, if feasible, of statutory deadlines and timelines for payment of, among others, Real Property Tax, Business Tax, as well as payment of taxes, fees and other charges set by law or local ordinances due and demandable by the 1st quarter of the year. Pursuant to Provincial Ordinance No. 322-2020, the payment of real property tax, with the 20% discount has been moved to May 31, 2020; H. Provide incentives and/or privileges to taxpayers and business establishments extending assistance during the COVID-19 crisis, by way of enacting ordinances; SECTION 19. SPECIAL RISK ALLOWANCE (SRA). A. LGUs are authorized to grant a one-time COVID-19 SRA equivalent to 25% of the monthly basic salary/pay to Public Health Workers (PHWs) who have great exposure to health risks and physical hardships in their line of duty, during this pandemic. B. The grant of SRA to PHWs including BHWs, shall be determined by the sanggunian concerned depending on the LGU's financial capability, at rates not exceeding the authorized amount subject to: 1. The PS limitations under R.A. No. 7160 in the case of employees of LGU; 2. Available MOOE allotments in the case of COS/JO workers and BHWs; 3. Conditions set by the government chargeable against the FY 2020 funds of the LGU concerned. C. Should the funds be insufficient to cover the COVID-19 SRA, a lower but uniform rate may be granted for all those who will qualify. SECTION 20. QUARANTINE FACILITIES FOR OFWs: Pursuant to R.A. No. 11469, and the Joint DOH-DOT-DILG Administrative Order No. 2020-001, returning OFWs shall not be refused entry to their residence LGUs; A. In instances that return/ repatriation was made with the assistance of OWWA, quarantine for 14 days shall be facilitated by the OWWA, prior to their return to their respective residences. A certification to such effect shall be shown by the OFW prior to entry to the LGU, which in turn, may, as far as practicable, facilitate additional quarantine period in an identified quarantine establishment or ensure that the OFW be monitored in strict home quarantine B. Component LGUs are mandated to identify sufficient number of quarantine facilities, appropriate to meet the needs of the community, with due consideration to the existing resources. Schools may be utilized, provided that an agreement with the school management/DepEd has been made or entered into. Other public facilities, such as, but not limited to multi purpose centers, and gymnasiums may be utilized as such; C. Private Accommodation Establishments may, pursuant to R.A. No. 11469, likewise be utilized as quarantine facilities, provided proper procedure mandated thereat be complied with. The said list must be submitted to the DOT/LGU concerned. A notice to the owners or authorized representatives of identified accommodation establishments will be issued. D. In cases where the accommodation establishments intend to volunteer their enterprise as Quarantine Facilities it shall submit a notice of such intent to the DOT /LGU concerned within twenty-four (24) hours from receipt of the notice from DOT/LGU concerned. E. Should an accommodation establishment identified as suitable Quarantine Facility unjustifiably refuse or signify that they are not capable of operating for such purpose, the DOT and DOH may recommend to the Office of the President the takeover of their operations subject to the limits and safeguards enshrined in the Constitution. SECTION 21. ADOPTION OF ECONOMY MEASURES IN THE GOVERNMENT DUE TO THE EMERGING HEALTH SITUATION. Pursuant to National Budget Circular No. 528 dated April 22, 2020 of the Department of Budget and Management, component LGUs are directed to adopt economy measures in this time of national emergency with the following purpose with guidelines specifically embodied in the said National Budget Circular: A. To provide for the possible measures for the discontinuance of appropriated PAPs, whether released or unreleased as well as unobligated allotments of covered entities, as of March 31, 2020 to fund the operations and response measures related to the COVID-19 emergency situation. B. To identify the unreleased funds for PAPs under the FY 2019 continuing appropriations and the FY 2020 GAA, which may already be discontinued or may no longer be completed within the current fiscal year; and C. To prescribe the submission of documents/reports to be used as bases on the discontinuance of said unobligated balances and identification of unreleased appropriations. SECTION 22. REORIENTING HOSPITAL OPERATIONS A. Visitors of existing hospital patients, who are non covid case/s, shall be limited to one at any point in time. Such visitors shall undergo thermal scans upon entry and exit of the hospital. Visitors exhibiting symptoms of COVID-19 infection shall be immediately directed to proper medical facilities and/or isolation centers. B. Medical consultations, outpatient and non-emergency cases shall not be accepted in the tertiary hospitals and those designated by DOH as COVID-19 treatment facilities. Instead, the said medical cases shall be referred tomedical clinics outside of hospital, infirmaries, RHUS and Level 1 hospitals. C. Subject to pertinent and/or applicable laws, the RiMC and private hospitals shall coordinate with the PHO and DOH and immediately report persons under investigation (PUI) or those with Covid 19 symptoms, to include but not limited to Acute Respiratory Infection with Diarrhea (ARI/D) and Severe Acute Respiratory Infection with Diarrhea (ARI/D). D. For this purpose and for the duration of the extended ECQ, the Pangasinan Provincial Hospital (PPH) shall temporarily not accept consultation, outpatient and non-emergency cases. Those with symptoms of Covid 19, shall be admitted to the isolation facility of the said hospital or to the designated isolation facility identified by the province. E. No medical facility shall refuse to treat patients in need of medical assistance. In the event that the required medical treatment or intervention is beyond or outside of the capacity of the medical facility, assistance shall be provided by making the proper/necessary referral to the proper medical facility. SECTION 23. SOCIAL ASSISTANCE. A. The Provincial Social Welfare and Development Office shall coordinate with the DSWD, DOLE, DTI, DBM and DoF in formulating programs and measures for including but not limited to: moratorium on lease rentals, advancing a prorated thirteenth (13th) month pay, reprieve in utility bills, and assistance to micro, small and medium-scale enterprises. B. The barangays are mandated to post and make public the beneficiaries of the Social Amelioration Program under Republic Act No. 11469 or the Bayanihan to Heal as One Act SECTION 24. SOCIAL DISTANCING. Workplace in the LGUs, public establishments like markets, municipal halls, private establishments catering to the public, churches or places of worship, and the likes must observe strict social distancing - that is the strict maintenance of a distance of at least one (1) meter radius between and among every person. SECTION 25. MANDATORY WEARING OF FACE MASK IN PUBLIC. Pursuant to Provincial Ordinance No. 235-2020 every person within the territorial jurisdiction of Pangasinan is required to wear face masks at all times, especially when going outside of their residences, at the workplace, when entering government buildings and offices, while leaving and going back home, when availing home essentials, and while in public places. Likewise, Provincial Ordinance No. 236-2020 prohibits any person from committing any act which causes stigma, disgrace, shame, humiliation, harassment or otherwise discriminating against a person infected, under investigation, or monitoring, due to the COVID-19, including public and private health workers/personnel, including their families and relatives, including returning OFWs. SECTION 26. PENALTY CLAUSE. Persons found in violation of these Rules shall be subject to administrative sanctions, and/or penalties under related Provincial Ordinances and R.A. No. 11469 or the Bayanihan to Heal as One Act. In case of resistance and serious disobedience, persons may be criminally liable under Art. 151 of the Revised Penal Code and other relevant provisions thereof. SECTION 27. EFFECTIVITY CLAUSE. This shall take effect immediately until or unless subsequently amended/revoked/revised.
